If you built your Squarespace website yourself or had a designer build it for you, there's a good chance you checked all the obvious boxes. Homepage, about page, services, contact form. Done.

But there's one thing a lot of small business owners miss, and it's not a design tweak or a missing blog post. It's a privacy policy. If your site doesn't have one, or it has one that hasn't been touched since you launched, that's worth paying attention to.

You might be thinking, "I'm not running a tech company. I don't collect data."

If your Squarespace site has a contact form, you're collecting personally identifiable information (PII). If you have Google Analytics installed, you're collecting data. If you use a newsletter signup, video embeds, or map widgets, you're collecting data.

Governments around the world have passed privacy laws to protect that information and those laws require most websites to have a privacy policy with specific disclosures. The requirements vary depending on where your visitors are located, not just where your business is based.

That means a one-page website for a wellness practice in Ohio could have website visitors from California (who has its own strict privacy laws) or the EU (hello, GDPR). That means they may need to comply with multiple privacy regulations at once.

The penalties for non-compliance can start at $2,500 per violation, per website visitor. And more recently, small business owners and even solo practitioners have been targeted by attorneys demanding tens of thousands of dollars in damages for websites that weren't compliant.

I don't write this to scare you. I have this conversation with every single client whose website I've built or worked on. Most people genuinely don't know what a privacy policy is or why it's important and you deserve to know how to best protect yourself and your business.

 

The Problem With a Generic Privacy Policy

Your first reaction might be to go and Google something like, "free website privacy policy" and copy/paste that baby onto your site. The problem is that so many websites have a privacy policy that was either copied from somewhere else, generated once and forgotten, or written so generically it doesn't actually cover what the site does.

The other issue? Privacy laws change regularly. New laws go into effect every year, so a policy that was compliant when you first launched your website may not be compliant today.
